IHA Legislative Meeting
The following issues were discussed at a recent legislative dinner meeting of the Idaho Housing Alliance. Mr. Jack Lyman, IHA Lobbyist was present to give the report to a group of over 20 members in Boise, ID. 

Karyn Felix opened the meeting as the new President. She recently replaced Don Kiehl of Nashua Homes who resigned the presidency because his company will not be concentrating on HUD homes in the near future.  Kiehl will stay on the board. 

Manufactured Housing Installation Legislation – This legislation was passed on the request of the Idaho State Division of Building Safety (DBS) to meet HUD requirements. The bill passed easily and the next step will be entering into negotiated rulemaking with DBS to work out how the bill might be implemented.

Landlord Tenant Act – For the first time in several years no changes were proposed to this act.

Energy Bill – Tax credit to owners if a home built before 2002 and the credit applies to duct work, windows and insulation. 

Tax Cut – The legislature gave a $35 million tax cut. This will look good in an election year for the legislators going home to their districts. 

Legislation – Once the elections are over Lyman extended the invitation to assist members to schedule a lunch with their legislators. This will be important if you have a newly seated legislator.

Service Providers – Lyman talked about the law requiring those working on manufactured homes to get a license from DBS. The IHA board and the Manufactured Home Board are having discussions on how to best handle these as it is not being enforced.  Some options include getting rid of the licenses or a modified version of the,

ITD Exemption – This involves the park model being transported by two’s on the same chassis. IHA negotiated a temporary change in the rule to allow for this. If you plan a trip involving this situation, please let the IHA office know a few days in advance as ITD would like to observe.

Exit Fee – David Wishney said the current law precludes the charging of an exit fee and there are costs when a home leaves a park. There was discussion on the possibilities of allowing for that kind of fee and it was concluded that it probably would not be successful. What about if the home is sold and relocated – could the community owner have first right of refusal? This might fly before the legislature because of the changed circumstances with poor financing and the market in North Dakota. 

Legal Issues:
Chad Bernards, an attorney who worked within David Wishney’s practice, talked about a court case involving an abandoned home in the Golden Gate Mobile Home Park. This was a case concerning foreclosure and the judge had some issues with the definition of abandoned home, because the filed summary judgment stated the owners of the home were still in possession, and denied the remedy. They can file a reconsideration motion or re-file summary judgment that states they are not longer in possession. We may need to take a second look at the possessory lien statute.

MHI Successfully Petitions HUD to Withdraw Notice on Design Requirements for Southern Pine

Responding in record time to a May 4th letter by MHI President Richard Jennison, HUD recently informed MHI that it will withdraw its notice giving manufacturers less than a month to meet new building design requirements for southern pine lumber used in manufactured housing and other types of wood frame construction.

In the May 4th letter, MHI asked HUD to withdraw its recent notice to Primary Inspection Agencies, announcing the new change to the HUD Code effective June 1, 2012. On May 11th, Ronald Spraker, Acting General Deputy Assistant Secretary for Housing, informed MHI it will send a revised notice as soon as possible to affected parties with the new compliance date of January 1, 2013.

As requested by MHI, Spraker said HUD will ask the Manufactured Housing Consensus Committee (MHCC) to review the updated version of the National Design Specification (NDS) for Wood Construction and it will consider rulemaking in accordance with federal statutory and regulatory requirements.

Accounting Error Leaves the MHCC Without A Contractor

In a surprise e-mail to the 21 members of the Manufactured Housing Consensus Committee (MHCC) on May 14th, the National Fire Protection Association (NFPA) announced that effective immediately it was withdrawing its support as the Administering Organization to the MHCC. Consequently, a previously scheduled wind task force meeting was cancelled and plans for the June meeting were put on hold. The reason sited by NFPA was non payment of outstanding invoices totaling $37,000.

Responding to an inquiry by MHI, HUD said the problem arose from an accounting system error. It is working to resolve the problem as soon as possible and is proceeding with plans for a summer meeting in Washington, D.C. NFPA said it will resume its activities as soon as the invoices are paid.

MHI’s Rae Ann Bevington to Become Director of Political Affairs for ACA International

MHI’s Vice President of Legislative and Political Affairs, Rae Ann Bevington, has accepted the newly-created position of Director of Political Affairs for ACA International, an international association of credit and collection professionals, based in Minneapolis, Minnesota. In her new position, Bevington will be responsible for raising the association’s profile and brand on Capitol Hill.

Bevington has been with MHI for four years, and her dedicated service is appreciated. Her last day will be May 24th. MHI wishes her great success in her new position with ACA International.
